Completion Reward Claim Terms and Conditions - Roundel Claim
Participants who successfully complete the full 500km between 24th December and 31st December 2019 can claim a reward from Rapha in recognition of their achievement. Entrants are required to submit their name, email address and Strava ID to complete the reward claim.
There is a limit of one (1) #Festive500 woven Roundel reward from Rapha per finishing participant. Participants are able to claim their #Festive500 reward between 00:01(GMT) on January 1st 2020 and 23:59 (GMT) on January 9th 2020. After this date, #Festive500 reward requests will not be accepted.
All #Festive500 woven roundels will be shipped by the end of March to participants who have claimed their reward within the specified dates. Delivery times will vary by location and local taxes and duties may be applied on delivery in some locales. It is the responsibility of the participant claiming the roundel to provide complete and accurate address details.
Spirit of the Festive 500 awards
The competition is open to everyone, except employees of Rapha Racing Limited and their immediate family. Competition opens on 01.01.20 at 00:01 (GMT) and closes on 21.01.20 at 23:59 (GMT).
These terms and conditions apply to Rapha online competitions. By participating in the competition, participants agree to be bound by these terms and conditions. Entrants are required to fill in their name and email address. By entering this competition, participants agree to be bound by these terms and that the decision of Rapha Racing Limited is final and binding in all matters relating to this competition.Results may be used for publicity purposes.

The entries for any of the prizes mentioned above will close at 23:59 (GMT) on 21st January 2020.
The winners will be selected in January by Rapha after review of the entries.
The winners will be announced during the week commencing 10th February 2020.
Prizes are non-transferable and there is no cash alternative. Prizes are subject to availability and confirmation. Prizes might not be as shown. Rapha, Canyon and Leica retain the right to change the specifications of the prize but will match with something of equal or near-to equal value. All other expenses not expressly stated or included in the prize are the responsibility of the winner(s).
Rapha Racing Limited reserves the right to substitute a prize or any part of it of equal or greater value, if this is necessary for reasons beyond its control. If no winner has claimed within two weeks from the closing date, after reasonable effort has been made by Rapha Racing Limited to notify the chosen winner, the prize may be forfeited. Rapha Racing Limited reserves the right to alter, amend or foreclose this prize draw without prior notice in the event that unforeseen circumstances make this unavoidable. Unfortunately, we are unable to send back physical prize entries. Strava Challenge Terms and Conditions - Official Rules

Rapha (“Sponsor”) is pleased to introduce the Rapha Festive 500 challenge (the “Skill Challenge”) made available at www.strava.com (the “Site”). As a condition of participating in the Skill Challenge, entrant (“You” or “Your”) agrees to be fully and unconditionally bound by these Official Rules and the decisions of Rapha, whose decisions shall be final and binding in all respects, and to waive any right to claim ambiguity in the Skill Challenge or these Official Rules.
HOW THE SKILL CHALLENGE WORKS
You may enter the Skill Challenge by going to the Site on or before 12/31/2019, clicking on the corresponding Skill Challenge URL that will direct You to the Skill Challenge landing page, where You will be entered into the Skill Challenge by clicking on the Join button. Starting from the day the Skill Challenge begins on 12/24/2019, you have until 12/31/2019 to ride 500 km. Each activity (Run or Ride) must be logged on the Site and cannot be inputted manually. For more information regarding how to log activities on the Site, please see Strava’s How It Works page (http://www.strava.com/how-it-works). If You successfully log ride 500 km between 12/24/2019 and 12/31/2019, You will be eligible to claim a reward, subject to Sponsor’s verification. Any form of entry and participation in the Skill Challenge other than that described herein is void.
By completing the challenge you will be eligible to claim a completion reward (see separate Completion reward claim terms and conditions). You will also be eligible to enter the Spirit of the F500 awards in which there will be four category prizes. Best Story, Best photographic entry, Worst of the weather and Epic Fail entries will be awarded. 1st prize is a Canyon Grail CF SL 8.0 ETAP with a custom Rapha #Festive500 design (Approximate Retail Value: £3,349), Photography category is a Leica D-lux 7 (Approximate Retail Value: £1000). The Worst of the weather prize winner will win a Rapha Gore tex jacket (Approximate Retail Value: £220). Epic Fail category prize is a set of Rapha Pro team transfer kit (Approximate Retail Value: £300).
Limit one (1) completion reward per person. No transfer, substitution or cash equivalent for prize will be made, except that Sponsor, at its sole discretion, may substitute a prize (or component of prize) of equal or greater value for any reason. Any depiction of prize, in Skill Challenge materials or otherwise, is for illustrative purposes only. All prizes are awarded AS IS and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose) by Sponsor. Prizes will be sent to the address on file with Sponsor at the time Your prize is won. Please be certain to keep Your address up to date. All prizes, including prizes shipped outside of North America, will be sent via U.S. Postal Service with the appropriate international postage (where applicable). We assume no liability for non-deliverability. In order to avoid shipping goods outside the U.S., Sponsor reserves the right to ship the Approximate Retail Value of the item via check or alternate payment as a substitute for the merchandise prize UP TO A MAXIMUM VALUE OF $350 USD. Sponsor reserves the right to cancel the Skill Challenge for any reason. In the event that the Skill Challenge is cancelled or postponed for any reason whatsoever, the ARV of the prizes will be awarded to the extent required by law. ODDS OF WINNING
The odds of winning will depend upon an entrant’s ability to complete the Skill Challenge.
Sponsor will announce the potential winners of the Skill Challenge within six (6) weeks after the conclusion of the Skill Challenge on 12/31/2019. All potential winners will be notified via the email address associated with the potential winner’s account and will be posted on Sponsor’s Site ( https://www.strava.com/challenges/rapha-festive-500-2019). Prizes will be deemed to have been won when all conditions in these Official Rules and accompanying Terms (http://app.strava.com/terms) are met.
ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR, WHOSE DECISION IS FINAL. AN ENTRANT IS NOT A WINNER OF ANY PRIZE, EVEN IF THE SKILL CHALLENGE SHOULD SO INDICATE, UNLESS AND UNTIL ENTRANT'S ELIGIBILITY AND THE CORRESPONDING COMPLETION OF THE SKILL CHALLENGE HAVE BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE.
Potential winners may, at the option of the Sponsor, be required to complete and sign an Affidavit of Eligibility and Liability Release, where legal, a Publicity Release, and IRS Form W-9. Failure to complete such forms within seven (7) days of receipt of such request will result in forfeiture of the prize. If a potential winner is not of the legal age of majority in the state of residence (""minor""), these documents may be required to be confirmed and signed by the potential winner's parent or legal guardian, and the prize may be awarded in the name of his/her parent or legal guardian who will be required to fulfill all requirements imposed on winner set forth herein.
In the event of non-compliance with these Official Rules, or if the prize is unclaimed or returned as undeliverable, the prize will be forfeited. Any forfeited prize may be awarded to an alternate winner, at Sponsor's discretion.
Except where prohibited by law, by entering the Skill Challenge, and as a condition of participating in this Skill Challenge, entrant agrees to allow Sponsor and/or Sponsor's designee the perpetual right to use his/her name, biographical information, photos and/or likeness, statements, voice and city and state address for advertising and promotional purposes for this and similar challenges, worldwide, and in perpetuity, in any and all forms of media, now known or hereafter devised without additional compensation, review or approval rights, notification or permission, except where prohibited by law.
ENTRANT FURTHER ACKNOWLEDGES THAT IF ENTRANT IS DETERMINED TO BE A WINNER, ENTRANT’S PERSONAL IDENTIFYING INFORMATION MAY BE DISCLOSED TO THIRD PARTIES INCLUDING, WITHOUT LIMITATION, PLACING ENTRANT’S NAME ON A WINNERS' LIST.
To obtain the names of the winners, any person may mail a self-addressed, stamped envelope after 30 days from the conclusion of the Skill Challenge to Rapha Attn: Winners’ List. Requests must be received no later than three (3) months after the conclusion of the Skill Challenge.
LIMITATIONS OF LIABILITY
Sponsor and the Released Parties (defined below) are not responsible for: (1) stolen, lost, late, misdirected, damaged, undeliverable or incomplete, inaccurate, delayed, illegible entries due to technical, computer, mechanical, printing, typographical, human or other errors relating to or in connection with the Skill Challenge, including, without limitation, errors which may occur in connection with the administration of the Skill Challenge, the mailing or transmission of entries, notification or correspondence, the processing of entries, the logging of miles, the announcement of the prizes or in any Skill Challenge related materials; (2) technical failures of any kinds; (3) failures of any of the equipment or programming associated with or utilized in the Skill Challenge; (4) unauthorized human and/or mechanical intervention in any part of the entry process or the Skill Challenge; (5) technical or human error that may occur in the administration of the Skill Challenge, the sending of entries or the processing of entries; or (6) any injury or damage to persons or property that may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Skill Challenge or receipt or use of any prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost or otherwise destroyed, corrupted or for any other reason not accepted as an entry into the Skill Challenge, entrant's sole remedy is to enter again into the Skill Challenge. Sponsor may rescind any Skill Challenge entry found to contain such errors or failures without liability at its sole discretion.
As a condition of participating in the Skill Challenge, entrant agrees to release, indemnify and hold harmless Sponsor and its respective affiliates, prize suppliers, and Sponsor’s business partners and all their affiliates, and each of their respective agents, representatives, officers, managers, directors, members, shareholders and employees (the “Released Parties”) from and against any injuries, losses, damages, claims, actions and any liability of any kind resulting from or arising from any breach of representation made by entrant in connection with the Skill Challenge, the exercise by Sponsor or its designees of any of the right granted by entrant in these Official Rules and entrant’s participation in the Skill Challenge, including acceptance, possession, use, misuse or nonuse of the prize(s), or any injury or for damage to entrant's or any other person's computer or wireless device relating to or resulting from participation in the Skill Challenge or downloading any materials in the Skill Challenge, or inability to access any website or wireless service associated with this Skill Challenge, or any combination thereof. Entrants agree that the laws of the State of California will govern any and all disputes.
As a condition of participating in the Skill Challenge, entrant agrees that as to Sponsor and the Released Parties (1) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses, (2) all causes of action arising out of or connected with the Skill Challenge, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and (3) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, but shall in no event include attorneys’ fees. Sponsor reserves the right to modify prize award procedures.
If in Sponsor's opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Skill Challenge, or if computer virus, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Skill Challenge, Sponsor reserves the right, at its sole discretion, to disqualify any individual who tampers with the entry process, the logging of miles and/or to modify, suspend or terminate the Skill Challenge. In the event that the Skill Challenge is cancelled or postponed for any reason whatsoever, the ARV of the prizes will be awarded to the extent required by law.
ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE SPONSOR’S SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SKILL CHALLENGE MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK CIVIL AND/OR CRIMINAL PROSECUTION AND DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW.

You will need to register to be able to access some services on the rapha.cc website (our “site”). When you register your details online, you are required to make sure that this information is accurate, current and a true representation of your personal details. You are also responsible for maintaining your personal information via your online account as well as for keeping your password secret.
The Terms of Service together with all our policies and procedures will be governed by and construed in accordance to the relevant United Kingdom law and the relevant courts of the United Kingdom will have exclusive jurisdiction.
Once your order is complete, you will be requested to provide personal and payment details. As part of the online transaction, we will perform a fraud credit check via our payment provider Cybersource. By submitting a payment through the site, you are granting permission for us to carry out such checks via Cybersource as required.
Orders on the site are subject to the required stock availability. Items added to your basket on the site will not be reserved for you, and are available for sale to other customers browsing the online store at the same time.
When you have finalised your order via the site, stock will be reserved for your purchase. However, sales will not be confirmed until the order dispatches from the warehouse, and payment is successfully taken.
Stock availability is determined by your delivery address, subject to stock availability at the warehouse in your locale. We are unable to offer customers stock from warehouses outside of their delivery-address service area.
All site pricing will be shown in local currency where available, and otherwise priced in US Dollars (USD). Payments are currently accepted in the following currencies: British pounds (GBP), US dollars (USD), Canadian dollars (CAD), Euros (EUR), Swiss francs (CHF), Japanese yen (JPY), Norwegian kroner (NOK), Swedish kronor (SEK), Danish kroner (DKK) and New Taiwan dollars (TWD). Orders can only be placed in the currency relating to your shipping country, and we are unable to offer alternative currency pricing to any customer.
All UK and EU pricing is shown inclusive of tax. Rapha uses a standard pricing policy for the UK and Channel Islands which ensures that all of our customers are charged the same final price, regardless of where they live. We do not offer VAT refunds on orders delivered to the Channel Islands. All total prices for goods displayed on the checkout page represent the total price payable by the customer for those items, regardless of the address for delivery. For EU deliveries, this price includes VAT (or VAT equivalent) at the current rate. Although this price is the same for deliveries outside the EU, where VAT (or VAT equivalent) may not be applicable, customers are not entitled to any discount or refund to account for the differences in tax treatment.
These customers will pay the same price for the item as a customer placing an order for delivery to the EU. Other components of the total price at the checkout, including delivery charge, may vary for each customer.
Import duties and taxes may be applied by your local authority. It is a legal requirement that we declare the full transaction value of the contents of all packages. Local import duties and taxes are levied by the carrier on behalf of the local customs authority.
US and Canada pricing is shown exclusive of sales tax, and sales tax may be added at the checkout, once the delivery address has been confirmed. No import duty is due on US orders, as these ship from within the United States. Canadian pricing is inclusive of import duty (see DDP below).
5. Duty Delivery Paid (DDP)
Pricing in the following territories is inclusive of duty and tax:
Switzerland, Japan, Norway, Canada (applicable tax shown at checkout)
Orders in these territories will be sent duty paid, meaning that no further import duty or tax will be payable after the order has been placed on the site.
6. Sale pricing adjustments
From time to time, Rapha will run discounted pricing on specific items as part of a sale or promotion. Subject to the sentence below, Rapha is happy to compensate the difference in price between the amount paid and the discounted price, in the form of a voucher, if the item was purchased at full price within 14 days of the commencement of the specific discount.
Please note that we are not able to offer any refund or voucher if the same item (inc. colour/size) is not in stock at the specific delivery address warehouse, as seen on Rapha.cc at the time of the request, or if the item was originally purchased at a discounted sale price, or if we have already provided a price match on the order.
7. Payment & Order Acceptance

Payments for all orders are taken on dispatch of goods, and are subject to fraud checks and checks by the card issuer.
By submitting your order on our site, you are confirming that the credit/debit card is yours or that you have authority from the cardholder to make the payment. We reserve the right to refuse payments & orders for customers who are not 18 years of age or older.
We will process your payments securely via the Adyen payments system, and all payment details will be encrypted. All stored card details will be stored securely on Adyen's secure servers.
Your payment and order will only be deemed as final when final payment is taken on dispatch of your goods. We reserve the right to refuse any payments or cancel orders at our own discretion.
8. Gift vouchers and e-vouchers
Gift vouchers and e-vouchers (“Vouchers”) cannot be bought using discount or promotional codes, and cannot be purchased with another Voucher.
Vouchers can be redeemed to purchase Rapha products only online, at Rapha.cc.
Vouchers can be redeemed in part, with the remaining balance left on the Voucher Code.
Vouchers purchased in a Rapha Clubhouse cannot currently be redeemed online at Rapha.cc, and visa versa.
‘RCC Membership Gift Vouchers’ can only be redeemed on RCC Membership.
‘Gift Vouchers’ and Clubhouse Vouchers’ cannot be redeemed on RCC Membership.
All vouchers (Gift Vouchers, Clubhouse Vouchers, and RCC Membership Vouchers) are single use, and are valid for twelve months. Vouchers cannot be used in conjunction with any other discount or voucher code, Rapha Travel trips or RCC membership.
If an order value is greater than the value of the Voucher, the difference must be paid by credit/debit card, or using Paypal.
Vouchers must be redeemed within twelve months of purchase and any unused balance will not be refunded or credited after such time.
Any balance credited from a part-redeemed Voucher must be used in the same currency as the first purchase it was redeemed with.
We are unable to replace vouchers if they are lost, stolen or damaged.
9. Returns & Exchanges
If you are not 100% satisfied with your purchase you can return it for an exchange or refund, provided it is within 30 days of receipt of your order and the item is as new and in the original packaging. All returns for orders over 28 days old must be sent back to Rapha within one month of the refund or exchange request being made. We reserve the right to refuse refunds for returned items, which are not in saleable condition.
Faulty items will either be replaced, repaired or refunded following evaluation by the Rapha Customer Services team. For the avoidance of doubt, faulty goods are classified as items that are received damaged or develop a manufacturing fault. Items damaged through general wear and tear are not classified as faulty. Faulty items can returned within twelve (12) months for a replacement or a repair. If this is not possible, we will offer a refund or credit voucher.
Returns are only accepted online for items purchased directly from Rapha.cc. If you have purchased your item from a Clubhouse, you should return the item directly to the Clubhouse where the item was purchased.
Products purchased as gifts can be refunded in full to the original purchaser; alternatively we can provide a credit in the form of a voucher to the gift recipient. Rapha is unable to refund postage on returned gift items.
Gift exchanges will show on the order history of the original purchaser. Please include a suitable delivery address for us to despatch exchanged products to.

10. Order cancellations under the Distance Selling Regulations/Consumer Contracts Regulations
For customers purchasing in the EU, under the Consumer Protection (Distance Selling) Regulations 2000 (“DSR”) for orders placed before 13 June 2014 and under the Consumer Contracts Regulations 2013 (“CCR”) for those placed on or after 13 June 2014; You have the right to cancel your order within a certain time frame. Rapha will honour such cancellation provided it is made within fourteen (14) days of receiving your items. Notice must be given in writing, either by email or by post to:

For all order cancellations through the DSR/CCR, you are eligible for a full refund including your shipping costs. Refunds will be processed within 30 days of us receiving your cancellation request. 11. Exceptions to the General Returns & Exchanges Policy
We offer a 30 day wear test guarantee on Rapha Classics products. If you are not 100% satisfied after 30 days of riding in these products, you can send them back to us for a full refund/credit. The Rapha Classics Guarantee applies to all items in the Rapha Classics collection.
This wear test Classics Guarantee does not cover accidental or crash damage.
The Classics Guarantee is limited to four products per customer per calendar year, and the same item can only be returned once.
The Classics Guarantee is only applicable to items purchased from Rapha.cc and Rapha Clubhouses. Proof of purchase is required for all refunds.
We reserve the right to remove this offer in the future. If the Classics Guarantee is withdrawn, we will honour the guarantee for thirty (30) days following its withdrawal from the site.
Personalised items cannot be refunded or exchanged once an order has been placed. It is the customer’s responsibility to ensure that all details entered for Personalised products are entered.
Cycling Shoes need to be tested on an uncarpeted surface, with no cleats attached.
All underwear must be returned unworn. We reserve the right to refuse any returned underwear garments which we believe to be worn.

12. Intellectual property rights

13. Clubhouse Ride terms
By entering a Rapha Clubhouse Ride, you are agreeing to the Eventbrite terms & conditions. You must also review and agree to the ride terms & conditions:
Helmet usage is mandatory on all Clubhouse rides. We reserve the right to refuse participation on rides if you are not wearing a helmet.
It is your responsibility to ensure that your bike is roadworthy, and that you are able to get yourself back under your own guidance.
You may be required to sign a waiver form before participating on a Clubhouse ride. A ride leader retains the right to refuse participation in a ride without a signed waiver form.
14. Rapha Travel Trips
All Rapha Travel trips are provided by Rapha Racing Limited and are subject to the following terms.
In booking your trip you confirm that you are over the age of 18 and have read, understood and accept these terms and conditions in their entirety.
14.2 Price and payment
Whilst we reserve the right to increase or decrease brochure prices at any time, once you have booked your trip and paid your deposit, the price shown on your booking confirmation is the guaranteed price of your trip. All advertised prices are inclusive of VAT. You must pay for your trip in full at least 60 days prior to your departure date. If you fail to pay for your trip in full 60 days prior to your departure date, we reserve the right to cancel your booking and your deposit will be forfeited.
14.3 Your obligations
You shall: follow the instructions of your Rapha professional guide at all times;ensure that you are of an appropriate level of fitness to participate in your trip; notify us of any medical ailments from which you suffer which may affect your ability to participate in the trip; wear a helmet at all times whilst cycling; not cycle when under the influence of alcohol or drugs; and ensure you have travel insurance, providing you with cover for baggage, cycling equipment and medical expenses whilst you are on your trip.
14.4 Our rights
We reserve the right to cancel or alter your trip at any time prior to your departure date, due to events outside of our control, such as but not limited to: acts of God, flood, drought, earthquake or other natural disaster; epidemic or pandemic; terrorist attack, civil war, civil commotion or riots, war, threat of or preparation for war, armed conflict, imposition of sanctions, embargo, or breaking off of diplomatic relations; nuclear, chemical or biological contamination; or collapse of buildings, fire, explosion or accident, (together “Events Outside Of Our Control”). We also reserve the right to cancel or alter your trip at any time prior to your departure date (at our discretion), although we assure you that we will endeavour to only do this when strictly necessary.
14.5 In the event that we cancel your trip
We will provide you with a £200 credit to use on another Rapha trip departing over the preceding two years. You will also be entitled to: (a) book any other available trip; or (b) receive a full refund of all monies paid; and we will not be liable for any flight or insurance costs you have incurred (it is for this reason that we recommend you delay booking flights and arranging insurance until your trip is confirmed). We reserve the right to stop you from participating on your trip if you: behave in an abusive and/or threatening manner; or engage in illegal activities.
14.6 Transferring your trip
Should a business or personal emergency cause you to not be able to go on your trip, you may transfer to any other trip, which: has space available on it; and is scheduled to depart within two years of the trip you originally signed up for. There is no charge for transferring all of your payments to another trip. Transfers made 60 days or fewer in advance will be considered a cancellation, and our standard cancellation policy (detailed above) will apply.
14.7 Alterations to your trip
We will use our best endeavours to ensure that the itinerary of your trip does not have to be altered. However, if an Event Outside Of Our Control occurs, we may not be able to follow our advertised itineraries or schedules. If any additional expenses are incurred through delay, accident or disruptions of planned itineraries due to Events Outside Of Our Control, we cannot compensate you for such expenses.
Bikes If you bring and ride your own bike on your trip, you hereby confirm and acknowledge that: it shall be suitable for your trip, well maintained and in good condition; and you shall be solely responsible for assembling, repairing and maintaining your bike during your trip If you rent a bike from us during your trip, we hereby confirm and acknowledge that: it shall be suitable for your trip, well maintained and in good condition; and we shall be solely responsible for assembling, repairing and maintaining your rented bike during your trip and you agree that you shall not attempt to assemble, repair or maintain your rented bike during your trip.
By booking your trip, you: acknowledge that you have received and read all guidance provided by us in relation to your trip; accept that any guidance given by us as regards climate, clothing, special equipment, topography etc is done so in good faith, but accept that we cannot confirm its accuracy or completeness; acknowledge that it is your responsibility to arrange insurance to cover you during your trip; confirm that you are aware of the physically strenuous nature of our trips and accept the risks and hazards of our trips, including the dangers inherent in cycling either on the road or off the road and any risks that result from (amongst other things) adverse weather conditions and the variable condition of roads and/or tracks; accept that: (a) whilst we may refer you to external activity operators during your trip, we have not done any due diligence on these external activity operators and do not provide any guarantee as to the services they provide; and (b) we shall not be liable for the acts or omissions of external activity operators and you participate in all activities organised by any such third parties on their terms and conditions and at your own risk. Confirm that you are sufficiently fit and healthy to complete your trip and are aware of no medical reason or condition which would prohibit you from completing your trip; accept the potential for (amongst other things) delays, alterations, loss of or damage to property, inconvenience and discomfort; and accept that subject to paragraph below, you participate in your trip ,and cycle, at your own risk.
Nothing in these terms & conditions limits or excludes our liability to you for death or personal injury caused by our negligence. To the extent your property is lost or damaged due to our acts or omissions, we shall be liable for the cost of repairing or replacing any such property, up to a maximum of £2,000 and we therefore suggest you bear this in mind when packing for your trip. Without prejudice to paragraphs and our entire financial liability whether in contract, tort (including negligence) or otherwise (including any liability for the acts or omissions of our employees, agents, consultants, and subcontractors) to you in respect of any breach of these terms and conditions shall be limited to the amount you paid for your trip. We shall not be liable to you for any: loss of, or damage to, your property caused by your own act or omission; or 10.4.2 claim for disappointment; or claim for loss of enjoyment; or loss incurred as a result of Events Outside of Our Control; or loss incurred due to the theft of bicycles; or loss incurred due to injury as a result of cycling either on or off road, unless such injury is caused by our negligence; or loss related to any business of yours such as lost data, lost profits, loss of business, loss of contracts, loss of goodwill or other business loss that you may incur as a result of any breach of these terms and conditions; or other special, indirect or consequential losses. All warranties, conditions and other terms implied by statute or common law are, to the fullest extent permitted by law, excluded from these terms and conditions. Nothing in these terms and conditions shall affect your statutory rights.
Comments and complaints If you have any concerns while on your trip, please communicate those concerns directly with your Rapha professional guide and allow us to address them immediately. If you feel the matter is serious, please feel free to contact our UK office by telephone, email or fax.
We may transfer our rights and obligations under these terms to another organisation, and we will always notify you in writing if this happens, but this will not affect your rights or our obligations under these terms. This arrangement is between you and Rapha Racing Limited. No other person shall have any rights to enforce any of its terms. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect. If we fail to insist that you perform any of your obligations under these terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you. These terms are governed by English law. Both you and Rapha Racing Limited agree to submit to the non-exclusive jurisdiction of the English courts.

18. Governing law and jurisdiction
These Terms & Conditions are governed by English law and you and we agree to submit to the non-exclusive jurisdiction of the English courts in respect of any matter arising hereunder.
